2PARTIES

5DEFINITIONS AND INTERPRETATION
In this Separation Agreement the following terms shall have the meanings assigned to them unless the context requires otherwise.

Children means the two children of the Applicant and the Respondent.

6SEPARATION AND COHABITATION
This Separation Agreement shall take effect from 1 January 2024.
The Applicant and the Respondent confirm that they have been living separately since the Date of Separation and that the last date they cohabited was 30 November 2023.
The Applicant and the Respondent each confirm that there has been no resumption of marital relations including sexual intimacy since the Date of Separation.
The Applicant and the Respondent agree not to cohabit with each other or with any other person in a manner that resumes marital relations during the period of this Separation Agreement.
7CHILDREN AND PARENTAL RESPONSIBILITIES
The Applicant is the primary resident parent. The parties agree to a shared living arrangement for the Children in accordance with the Children Act 1989. The arrangements set out below have been considered with reference to the welfare checklist under section 1(3) of the Children Act 1989 and the parties confirm that these arrangements are in the best interests of the children.
The non-resident parent shall have weekly contact with the Children in accordance with the following schedule the non-resident parent will have the Children every other weekend from Friday evening to Sunday evening and one evening per week from 5pm to 8pm.
The Applicant and the Respondent agree to specific arrangements for holidays and school breaks which shall be agreed between them in writing no less than 28 days in advance. The parties shall consult on all major decisions regarding the Children\’s schooling.
The Applicant and the Respondent shall have joint responsibility for decisions about the Childrens education and medical care.
The primary resident parent shall have responsibility for decisions about the Childrens religious and cultural upbringing.
The Applicant and the Respondent confirm that neither intends to relocate with the Children within the United Kingdom or abroad without the written consent of the other party and any court order as may be required under the Children Act 1989.
The Applicant and the Respondent agree to joint consent for the Childrens passport and international travel and neither shall unreasonably withhold such consent.
In the event of a change in circumstances the parties agree to review these arrangements and attempt to resolve any disputes through mediation focused on the welfare of the children before applying to court.
8FINANCIAL ARRANGEMENTS MAINTENANCE
The Applicant shall pay to the Respondent spousal maintenance in the sum of 750.00 per month. This amount shall be index-linked and increased annually in line with the Retail Price Index (RPI) or Consumer Price Index (CPI).
The spousal maintenance payments shall be made monthly in advance by direct bank transfer commencing on 2024-01-01.
The spousal maintenance payments shall continue for a fixed period of five years from the commencement date subject to the provisions for variation set out below. The parties acknowledge that this agreement is intended to achieve a clean break in relation to spousal maintenance under section 25A of the Matrimonial Causes Act 1973 at the end of the fixed term or upon variation to a nominal order if applicable. If a clean break is not achieved the parties agree to seek a consent order reflecting this position.
The obligation to pay spousal maintenance shall cease upon the death of the Respondent or the remarriage or cohabitation of the Respondent for a period exceeding six months. This obligation may be varied by the court on application by either party under section 31 of the Matrimonial Causes Act 1973 in the event of a material change in circumstances.
The parties acknowledge the tax treatment of spousal maintenance payments under current UK tax rules (no tax relief for the payer and not taxable for the recipient).
9FINANCIAL ARRANGEMENTS CHILD MAINTENANCE
The Respondent shall pay child maintenance to the Applicant for the benefit of the Children calculated in accordance with the Child Support Act 1991 and the standard Child Maintenance Service calculation.
The child maintenance payments shall be made monthly by direct bank transfer to the receiving parents account commencing on 2024-01-01.
The Applicant and the Respondent agree that the child maintenance payments may be varied in accordance with any changes in circumstances including changes in the income of either party or the needs of the Children.
In addition to the standard child maintenance the Respondent shall pay a proportionate share of additional expenses for the Children including school fees extracurricular activities and medical costs not covered by the National Health Service.
10PROPERTY DIVISION
The Applicant and the Respondent agree that the Family Home shall be placed on the market for sale as soon as reasonably practicable and the net proceeds of sale after discharge of the mortgage and reasonable selling costs shall be divided equally between them.
The Applicant and the Respondent agree that each shall keep their own personal property including furniture vehicles and household items in their respective possession at the Date of Separation.
The Applicant and the Respondent each consent to the proposed division of property as set out in this clause. This division is intended to be in full and final settlement of all claims under sections 24 and 25 of the Matrimonial Causes Act 1973. The parties agree to consent to a consent order in the divorce proceedings incorporating the terms of this agreement.
11CAPITAL PROVISION
This agreement represents full and final settlement of all capital claims between the parties. There shall be no lump sum payments savings division or transfers of other capital assets beyond those set out in the Property Division section.
Each party releases the other from all claims under sections 24 and 25 of the Matrimonial Causes Act 1973 in respect of capital provision and agrees that this agreement shall be incorporated into a consent order upon divorce.
12PENSIONS
The Applicant and the Respondent each consent to full disclosure of all pension information for the purposes of this Separation Agreement.
The Applicant has the following pension schemes accumulated during the marriage Workplace Pension with Aviva at 80 Fenchurch Street London EC3M 4BY policy number WP123456789 which commenced on 2010-01-15 with an estimated current value of 150000.50 and Personal Pension with Legal & General at Temple Court 11 Queen Victoria Street London EC4N 4TP policy number PP987654321 which commenced on 2010-01-15 with an estimated current value of 150000.50. The Applicant has individual debts including a personal car loan with Lloyds Bank which commenced on 2020-03-10 with an outstanding amount of 12000.50 and the Applicant shall be solely responsible for this debt.
The Applicant is aware of individual debts of the Respondent and each party shall be solely responsible for their own individual debts incurred after the Date of Separation.
The Applicant and the Respondent confirm that there are no other financial liabilities such as guarantees or contingent debts of which they are aware.
14INSURANCE POLICIES
The Applicant and the Respondent have a joint life insurance policy with Aviva Insurance policy number LI-456789 with coverage of 250000.00 which commenced on 2015-03-15 and the Applicant shall pay the ongoing monthly premium of 85.50.
The beneficiary on the life insurance policy shall be changed to the Applicant or a new beneficiary nominated by the Applicant.
The Applicant and the Respondent have health or medical insurance policies and home insurance and car insurance policies which shall be maintained by the party whose name is on the policy or as otherwise agreed in writing.
15CONFIDENTIALITY
The Applicant and the Respondent agree to keep the terms of this Separation Agreement the personal and family matters and the financial arrangements confidential and not to disclose them to any third party except as required by law or for the purpose of obtaining legal or financial advice.
The confidentiality obligations shall apply equally to both the Applicant and the Respondent.
16NON-DISCLOSURE OF INFORMATION
The Applicant and the Respondent agree that from 2023-10-15 neither shall disclose to any third party any financial records or health and medical information obtained during the marriage except as required by law or for the purpose of legal proceedings.
The non-disclosure obligations shall apply mutually to both the Applicant and the Respondent.
17DISPUTE RESOLUTION
Any dispute arising out of or in connection with this Separation Agreement shall first be referred to mediation before either party may commence arbitration or court proceedings.
The costs of any dispute resolution shall be shared equally between the Applicant and the Respondent.
All dispute resolution proceedings shall be confidential.
This clause shall be governed by the laws of England and Wales.
